EEOC Gives Guidance on Opioid Use

Positive and Negative test results are not so simple anymore!  If you have an employee who tests positive for any legal drug, including  opiates, you may have certain considerations under ADA to think through.  This link provides a concise outline of the Guidance offered by the EEOC when your employee tests positive for legal drugs.

Always, always enlist an experienced Medical Review Officer (MRO) to ask the initial questions, get copies of the Rx’s, and have that sensitive discussion with the employee.  Then you have a frank discussion with the MRO, if he/she determines the drug use is prescribed) to better understand the ramifications of taking the drug on the job and what accommodations, if any, might be considered.
